Thank you for visiting the Megga Websites and Services owned and operated by Megga, Inc., (“Megga”). We use the words "we," "us" or "our" and similar pronouns to refer to Megga, Inc., its affiliates, and subsidiaries, doing business as Megga, Inc., in this Privacy Policy.   We use the term user, member, you, your, and similar pronouns, sometimes singular and sometimes plural to refer to consumers and users of the Megga Services.  Both singular and plural descriptors are used and are intended to be universally applicable and should not be interpreted to be restrictive or limiting.   If you would like to join any of the Megga Websites and utilize the Services that are offered, you must read and agree to the terms of this Privacy Policy (“Policy”).

The following discloses our information gathering and dissemination practices for the Megga Inc. Websites and Services (collectively “Websites” or “Services – singular and plural versions may be used interchangeably throughout this Policy and are not intended to be limited or restrictive in scope.). Overview.

In order to offer the Services, we collect Personal Information, including Personally Identifiable Information, Sensitive Data, and other data and information (collectively “Information”) about our users. Personally Identifiably Information is information that can be used on its own or with other information to identify, contact, or locate a single person or identify an individual in context. “Sensitive Data” includes information, comments or content (e.g. photographs, video, profile, lifestyle) that you optionally provide that may reveal your ethnic origin, nationality, religion and/or sexual orientation. Information Provided to Us.

The Megga Inc. family of businesses is comprised of a number of different websites and offerings.  The exact Services offered are constantly growing and evolving.  We may obtain your Information from other Megga Inc. businesses, business partners, contractors and other third parties which may be stored separately or with other information we have collected about you. When you access or use our Websites or Services, you authorize us to access or collect information made available by the third party site in accordance with its privacy policy. This information may be available from your profile or account with such site or from cookies placed on your device by the third party platform.

 

Information about Others.

Through your use of the Services you will be exposed to personally identifiable information of other users including but not limited to names, usernames, and other contact information. By accepting this Privacy Policy and by your use or continued use of the Services, you agree that you will not use the information you collect or are exposed to regarding any other member in any way which violates the terms and conditions of any Megga Service(s) or is in any way harassing or could be considered solicitation or which another user has not consented to.    You must also not collect and/or store any information gathered from the Services in any database or similar storage medium for any purpose.   In all cases, you must give users an opportunity to remove themselves from your database should you fail to comply with this policy. In addition, under no circumstances, except as defined in this Privacy Policy, may you disclose personally identifiable information about another user to any third party. Megga Inc. does not permit spam messages or unsolicited marketing efforts on any Megga Service or Website. You are not permitted to add a Megga Inc. member to any mail or distribution list(email or physical mail), or contact any Megga user for any commercial purpose without their express consent after adequate disclosure. Use of Cookies and Other Technologies.

We use various technologies to collect information about your activities on our website.  This can include the use of cookies and trackers as defined herein.

 

Information Collected Automatically.

We automatically collect information from your browser or device when you visit any of our websites. This information includes but is not limited to your IP address, device ID, your browser type and language, access times, the content of any undeleted cookies that your browser previously accepted from us (see “Cookies and Use of Cookie and Other Data” below), and the referring website address.

Information Collected by Third-Parties.

We allow service providers, Megga Inc. companies, advertising companies, ad networks and other third parties, to display advertisements on our Websites and Services. We do not provide any non-masked or non-obscured personal information to these third parties.

 

Financial Information.

We may use financial information or payment method information to (i) process payment for any purchases, (ii) enroll you in the discount, rebate, and other programs in which you elect to participate, (iii) to protect against or identify possible fraudulent transactions, and (iv) otherwise as needed to manage our business.  Other than payment and transaction records, we do not store your payment information without your express permission granted to us through the Services or Websites.

 

Personal Information.

This Privacy Policy sets forth what we do with the Information we gather as a result of your usage of the Services. We may share Information with third parties with whom Megga has a business relationship.  This includes Megga’s affiliates and business partners as well as third party service providers that assist in providing the Services.  Megga never shares or sells Information with non-affiliated third parties.  Megga may share non-identifying information with any third parties so long as the information is not personal in nature and cannot be used to identify, either directly or indirectly, any particular individual user.

 

Other Situations.

We also may disclose your information, including personal information:

  • In response to a valid subpoena or similar investigative demand, a court order, or a request for cooperation from a law enforcement or other government agency; to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law. In such cases, we may raise or waive any legal objection or right available to us.

Aggregated and/or Non-Personal Information.

We may share non-personal information we collect under any of the above circumstances. We may also share it with Megga Inc. companies and third parties to develop and deliver targeted advertising on our Websites and Services and on websites or applications of third parties, and to analyze and report on advertising you see. We may combine non-personal information we collect with additional non-personal information collected from other sources. We also may share aggregated, non-personal information, or personal information in hashed, non-human readable form, with third parties, including advisors, writers, researchers, partners, advertisers and investors for the purpose of conducting general business analysis, advertising, marketing, or other business purposes. The cookies may reflect de-identified demographic or other data linked to data you voluntarily have submitted to us (such as your email address), that we may share with a data provider solely in hashed, non-human readable form. We may also share your geolocation information in de-identified form with Megga Inc. companies and third parties for the above purposes.

 

Third-Party Websites.

There are a number of places on our Websites and Services where you may click on a link to access websites belonging to a third party.  This Policy does not apply to any third party websites that you access from our Websites or Services that are not part of the Megga family of Services. These third-party websites may independently solicit and collect information, including personal information, from you and, in some instances, provide us with information about your activities on those websites. We recommend that you consult the privacy statements of all third-party websites you visit prior to sharing any personal information on said site.  Megga and its affiliates are not responsible for the privacy practices of any third parties or for how third parties treat your Information.

 

Accessing, Reviewing and Changing Your Profile.

Following registration, you can review and change the information you submitted during registration. For instructions on how to do so, visit the Help section of the Websites or Services. If you change your password and email address we will retain a record of your old password and email address. You can also change your registration information such as: name, address, city, state, zip code, country, phone number, profile, likes and dislikes, desired profile and saved search criteria.

Upon your notification, we will remove your membership from our active databases as soon as reasonably possible in accordance with our policy and applicable law. To learn how to hide or remove your profile so that others cannot view it, visit the Help section of the Website.

We will retain in our files information you have requested be removed from our active databases for certain purposes, such as to resolve disputes, troubleshoot problems and enforce our terms and conditions. Further, such prior information may never be completely removed from our databases due to technical and legal constraints, including stored ‘back up’ systems. Therefore, you should not expect that all of your personally identifiable information will be completely removed from our databases in response to any request you may submit.

 

Control of Your Password.

You are responsible for all actions taken with your login information and password, including fees. Do not disclose your Megga Inc. passwords or login information to any third party. If you choose to share this information with any third party, you are responsible for all actions taken with your login information and password, and therefore should review each third party’s privacy policy. If you lose control of your password, you may lose substantial control over your personally identifiable information and may be subject to legally binding actions taken on your behalf. If your password has been compromised in any way, you should immediately change your password.

 

Data Retention.

If you have an online account with us, you may delete or disable your account at any time by visiting the "Settings" page for your account. If you delete or disable your account, we will retain certain data for analytical purposes and recordkeeping integrity, as well as to prevent fraud, collect any fees owed, enforce our terms and conditions, take actions we deem necessary to protect the integrity of our Websites and Services or our users, or take other actions otherwise permitted by law. In addition, if certain information has already been provided to third parties as described in this Privacy Policy, retention of that information will be subject to those third parties' policies.  Megga, in its sole discretion reserves the right to set policies regarding information retention, and may, in the future choose to permanently delete information related to any Account.  Megga is not liable or responsible for any loss of information that results from the deletion, modification or suspension of any Account.

 

Your Choices About Collection and Use of Your Information.

You can choose not to provide us with certain information, but that may result in you being unable to use certain features of our Websites and Services because such information may be required in order for you to register as a member; purchase products or services; participate in a contest, promotion, survey, or sweepstakes; ask a question; or initiate other transactions on our Websites or Services.

When you register on our Websites or Services, you consent to receive email messages from us. At any time you can choose to no longer receive commercial or promotional emails from us by submitting this request to customerservice@megga.com. You may be given the opportunity, in any commercial email that we send to you, to opt out of receiving such messages in the future. We request a reasonable time to process an opt-out request. We may send you other types of transactional and relationship email communications, such as service announcements, administrative notices, and surveys, without offering you the opportunity to opt out of receiving them. Please note that changing information in your account, or otherwise opting out of receipt of promotional email communications, will only affect future activities or communications from us. If we have already provided your information to a third party (such as a service provider) before you have changed your preferences or updated your information, you may have to change you preferences directly with that third party.

 

If you object to the collection of your Information and the treatment of your Information in accordance with this Policy, your only recourse is to refrain from use of the Websites and Services.

 

Protection of Your Personal Information.

We take appropriate security measures (to help safeguard your Information from unauthorized access and disclosure. However, no system is completely secure. Therefore, although we take steps to secure your information, we do not promise, and you should not expect, that your Information, searches, or other communications will always remain secure. Users should also take care with how they handle and disclose their personal information and should avoid sending personal information through insecure email. Information You Provide.

We provide areas on our Websites and Services where you can post information about yourself and others and communicate with others or upload content such as photographs. Such postings are governed by the Terms and Conditions of each Website or Service. In addition, such postings may appear on other websites or when searches are executed on the subject of your posting. Also, whenever you voluntarily disclose personal information on publicly viewable web pages, that information will be publicly available and can be collected and used by others. For example, if you post your email address, you may receive unsolicited messages. Children's Privacy.

Although our Websites and Services target a general audience, we restrict the use of our Websites and Services to individuals age 13 and above.  Some of our Websites and Services are only available to individuals 18 years old and above. We do not knowingly collect personal information from children under the age of 13.

 

No Rights of Third Parties.

This Privacy Policy does not create rights enforceable by third parties or require disclosure of any personal information relating to users of the Websites and Services.

We may change this Privacy Policy from time to time based on changes in the law, your comments, or our need to accurately reflect our data collection and disclosure practices.
